tus peralihan tanah dari PT Citra Tama Selaras (CTS) kepada PT Jimbaran Hijau (JH) selaku pelaksana megaproyek BIP belum sah secara hukum, sehingga terindikasi dapat merugikan negara hingga puluha

n miliar rupiah.
  "Secara yuridis belum sah peralihan tanah antara PT CTS kepada PT JH, karena kedua perusahaan ini masih sebatas melakukan perjanjian dan kuasa jual-beli. Selain itu status tanah juga belum dibaliknamakan kepada PT JH," ujar 

Kepala Kantor Badan Pertanahan Nasional (BPN) Badung Tri Nugraha, Selasa (26/7), di Denpasar.
  Megaproyek BIP ini dibangun sebagai sarana untuk menunjang pelaksanaan pertemuan internasional APEC pada 2013 mendatang di Jimbaran, Bali. Masalah ini menjadi ramai diberitakan media karena sejumlah pejabat tinggi terkesan ikut "mengintervensi" dalam proses pemberian ijin pembangunan megaproyek BIP. Pejabat tinggi itu antara lain Gubernur Bali I Made Mangku Pastika dan Menteri Kebudayaan dan Pariwisata (Menbudpar) Jro Wacik. Kedua petinggi ini beberapa waktu lalu telah mengirim surat kepada Bupati Badung AA Gde Agung yang intinya minta agar Gde Agung memberikan surat ijin bagi pembangunan megaproyek BIP.
  Namun sampai saat ini Gde Agung masih belum mengeluarkan ijin, sehingga pelaksanaan pembangunan megaproyek BIP menjadi tersendat-sendat. Sebagaimana diketahui, PT CTS dan PT JH masih sama-sama dalam "satu atap". 
  Tri Nugraha mengaku pihaknya sudah melakukan koordinasi dengan Bupati Badung AA Gde Agung terkait dengan status tanah yang akan dijadikan lahan bagi pembangunan megaproyek BIP itu. "Kepada Bapak Bupati Badung telah saya jelaskan mengenai status tanah itu, yakni belum dibaliknamakan ke PT JH," papar Tri Nugraha.
  Ia menjelaskan, PT CTS memiliki sertifikat hak guna bangunan (HGB) atas lahan sekitar 180 hektare di Jimbaran. Sebagian lahan ini akan dialihkan kepada PT JH untuk dibangun megaproyek BIP. Namun, imbuh Tri Nugraha, peralihan ini masih sebatas perjanjian dan kuasa jual-beli antara PT CTS dengan PT JH dan belum dibuatkan akte jual-beli di PPAT. Selain itu, paparnya, status tanah juga belum dibaliknamakan ke PT JH.   "Kalau ada pengikatan jual-beli di PPAT, kedua belah pihak harus membayar pajak PPH dan PPHTB yang nilainya mencapai puluhan miliar. Karena belum ada pembayaran pajak, maka ini berpotensi merugikan negara yang nilainya mencapai sekitar Rp 20 miliar," tutur Tri Nugraha. 
  Menurut Tri, BPN Badung tidak menghambat rencana pembangunan megaproyek BIP itu, apalagi akan digunakan sebagai sarana pelaksanaan pertemuan internasional APEC. "Yang berkewenangan mengeluarkan ijin pembangunannya adalah Bupati Badung, sedangkan BPN Badung hanya sebatas menyampaikan status tanah kepada Bupati Badung," kata Tri Nugraha.
  Ia menyatakan pihaknya siap membantu dan mendukung dalam proses baliknama tanah itu dari PT CTS kepada PT JH. "Kalau semua persyaratan sudah lengkap, proses pembuatan sertifikat baliknama akan kami selesaikan sekitar dua minggu sejak permohonan masuk," tandasnya.(Tety)
